WHAT IS THE PARTY WALL ACT?

The Party Wall Act covers 3 distinct areas of work; changes to an existing party structures, the construction of new walls at the boundary and excavation within 3 or 6 metres of a shared or adjoining structure. An owner proposing to undertake any such work (known as the “building owner”) is required to formally notify the owners of affected neighbouring properties.

If the owner of the neighbouring property (known as the “adjoining owner”) does not consent to the notice, a dispute arises and both parties must appoint a surveyor, or concur in the appointment of a single ‘agreed’ surveyor. The surveyors produce a document called a “party wall award”.

The award confirms the building owner’s right to undertake the work but only in a way that minimises the risk of damage and ensures that the occupants of the adjoining owner’s property do not suffer unnecessary inconvenience. As part of the process, the condition of the adjoining owner’s property is recorded so that if damage is reported either during or following the works, there is a prior record to check it against.

GERRARDS CROSS

Gerrards Cross is a prestigious town in Buckinghamshire, located between the elegant Beaconsfield to the northwest and the leafy suburb of Ruislip to the southeast. Excellent service overall from Shaun Blake at Peter Barry Surveyors.The initial survey had to be postponed last minute due to a potential collapse in the chain, but that was no problem.The report was exceptionally detailed and comprehensive, very often including details and recommendations which I would not have expected e.g. it is recommended that you enquire about this document further etc.The follow up service was also exceptionally good, with a walkthrough of the issues raised in the report in plain English, including e.g. X may take a roofer 3-4 days, Y will probably be 2-3 more years before it becomes a more serious concern etcFinally, Shaun said he would be happy to take a look over specific documents we had requested on the back of the survey, and when we sent these on he swiftly replied with a very useful and entirely comprehensive review.

After being disappointed by a different surveyor in Holborn, I approached this company which had great reviews and I decided to go ahead. Mr Steve Hobbs carried out the survey for my flat and also to put on the report how much the lease extension should cost. The Landlord however was very unreasonable and wanted nearly £10k more than what Mr Hobbs had stated and so Mr Hobbs went ahead with the negotiation and managed to get the premium down to nearly £10k less than what the unruly landlord wanted.
