A common misconception adjoining owners have is that party wall surveyors have the power to deal with every aspect of building works that has the potential to affect them. The planning process and the party wall process are entirely separate and party walls surveyors have no say over planning decisions.

One of our team of Surveyors, James Merewether, recently acted for adjoining owners in a party wall dispute in Hampton regarding the construction of a large rear and side return extension proposed by their neighbours. Although the building works were extensive and the adjoining owners had various concerns, James carefully explained that the only part of the works falling within the scope of the Act was the excavation of the foundations to the flank wall of the extension (being within 3 metres of their property).

The Award was served and works completed without any issues, much to the relief of the adjoining owners.
