Many owners are not aware that excavating on their own land, back from the boundary, may still fall within the scope of the Act and be notifiable to an adjoining owner but its inclusion is logical as there is a risk of ground movement. The criterion for inclusion seeks to assess that risk, albeit in simple terms – where the excavation is within 3.00m of an adjoining or shared structure, and to a greater depth than the base of the foundations to that structure, the risk of movement is sufficient to trigger the Act’s procedures.

We recently served a Notice of Adjacent Excavation on behalf of the owner of a semi-detached house just north of Silvertown who was proposing to add a single storey rear extension with the flank wall set back from the boundary. Although the excavation of the foundations to the extension fell within the scope of the Act, the adjoining owner appreciated that the risk of damage was low and was happy to consent to the notice.

Our client opted to instruct us to undertake a inspect and produce a Level 3 Home Survey/Building Survey of this property in the in the Canning Town area.

The house was middle of terrace with a single storey rear extension. Defects arising included deteriorating pitched and flat roof coverings; defective and missing guttering; dampness issues and associated risk of decay in floor timbers.

About Canning Town

The area has been the subject of a major regeneration programme since 2012 with a long term plan to build 10,000 new homes. The £3.7 billion project, which takes in Customs House, has begun to transform the area with a new town centre due to be completed in around 2014.

Canning Town was also the location of one of East London’s most infamous buildings, Roman Point. The 22-storey tower block partly collapsed shortly after it had opened in 1968 following a gas explosion. The blast damaged some load-bearing walls causing a corner of the building to collapse resulting in the death of 4 people. It contributed to the stigma around tower blocks and led to changes in the way they were constructed.
