In this case, the building owner had served their own notices to cover works including the demolition of a garden brick wall and rebuilding it as the flank wall of a rear extension. The adjoining owner appointed our colleague Matthew Price and was happy for him to act as the Agreed Surveyor. The adjoining owner’s property was recorded in a schedule of condition and a party wall award served, which covered the access requirements necessary for the contractor to undertake the work at the boundary.

Under the Act, 14 days’ notice needs to be given but this is often shortened by agreement. Typical protection involves the erection on 2m high timber hoarding to shield the adjoining owner and their property from the works, with any shrubs protected and/or potted items relocated.

The re-building of a brick boundary wall as a flank wall also allows the adjoining owner to construct any future rear extension by enclosing upon the same wall, which is preferable to constructing 2 walls next to each other.

About Victoria Park

Victoria Park is a large open space that extends between Bethnal Green and Hackney Wick in East London. The area to the north-west of the park is known locally as Victoria Park Village.

This is one of the more gentrified parts of Hackney where tables and chairs from the many restaurants and cafes along Victoria Park Road and Lauriston Road spill out onto the streets.

The Park itself was opened in 1845, making it the capital’s oldest public park, and attracts 9 million visits per year. Facilities within the park’s 86.18 hectares include a skatepark, football pitches and a choice of cafes. The boating lake to the west of the park had a cameo in the 2014 John Lewis Christmas advert – Monty the Penguin can be seen having a dip with the local pigeons.

Transport links around the park are good with Bethnal Green Central Line Station to the south-west and Hackney Wick Overground Station to the north-east.
