The work that trips up most building owners, in terms of the party wall act, is excavation, typically for new foundations. In some ways, it’s strange that an owner should have to notify their neighbours when excavating on their own land but, depending upon the proximity and depth of the proposed excavation, there may be a significant risk of ground movement.

On a recent job relating to a part single, part two storey extension a detached property just north of Hadley Wood Station in EN5, our surveyor Callum Escott had to consider the implications of a 1.7m deep foundation trench within 3.00m of the adjoining property. Callum acted for the adjoining owner and therefore had to ensure that the risk of damage to their property was minimised as far as reasonably possible.

This was achieved by requiring the contractor to ensure that no ensure that excavations within 3 metres of the adjoining owner’s property did not remain open for longer than 48 hours and were covered when rain was forecast. Both of these provisions were designed to prevent the sides of the trench from become unstable.
