WHAT IS THE PARTY WALL ACT?

The Party Wall Act covers 3 distinct areas of work; changes to an existing party structures, the construction of new walls at the boundary and excavation within 3 or 6 metres of a shared or adjoining structure. An owner proposing to undertake any such work (known as the “building owner”) is required to formally notify the owners of affected neighbouring properties.

If the owner of the neighbouring property (known as the “adjoining owner”) does not consent to the notice, a dispute arises and both parties must appoint a surveyor, or concur in the appointment of a single ‘agreed’ surveyor. The surveyors produce a document called a “party wall award”.

The award confirms the building owner’s right to undertake the work but only in a way that minimises the risk of damage and ensures that the occupants of the adjoining owner’s property do not suffer unnecessary inconvenience. As part of the process, the condition of the adjoining owner’s property is recorded so that if damage is reported either during or following the works, there is a prior record to check it against.

Steve Hobbs, one of our team of Chartered Surveyors, recently completed a Level 2 Survey for the purchaser of a modern purpose-built flat in Ruislip.

Despite the property having been built less than ten years ago the survey uncovered a number of issues, including installation defects to large set of expensive folding patio doors, significant cosmetic damage to the kitchen units caused by the current occupants, and a significant leak from the sealed central heating installation which will be fairly disruptive and expensive to remedy. Even where a property is relatively recently built there can still be defects which in some cases will be difficult and / or expensive to remedy.

Following our advice and comprehensive report the client was fully armed with the information and advice necessary, including recommendations for further investigations required where appropriate, to make an informed decision about their property purchase.

Our specialist valuation surveyor, Steve Hobbs, recently carried out valuation for a Help to Buy loan redemption for a modern purpose-build flat in Harrow.

The client had already agreed a sale of the property, and Steve was able to confirm that the agreed sale price presented the full market value of the property, thereby enabling the sale to proceed. Unfortunately there were a number of delays in the transaction, which was part of a larger chain. Homes England determined that, due to these delays, the property would have to be revalued, not once but twice during the course of the transaction!

On both occasions we were able to carry out the required revaluations at short notice, enabling the sale to stay on track. We were pleased to hear once the sale had completed that our client was in a position to move into their long-awaited new home.
