The Party Wall Act confirms that the party undertaking the works is responsible for any loss or damage suffered by the adjoining owner and that disputes should be determined by the appointed surveyors. However, it provides no further guidance on how the dispute should be resolved and that can differ considerably depending upon the scale of the damage.

Our Director Justin Burns recently completed an inspection of an adjoining property just off Heath Road in Twickenham following completion of the building owners’ rear extension. Some minor damage was noted to the adjoining owners’ kitchen.

Technically, the owners should be left to resolve the issue but experienced surveyors will use their experience to guide the owners and facilitate an agreement. In this case, the contractor agreed to the surveyors’ suggestion that he should return and make good the damage and the adjoining owners were pleased with the work.
