The final inspection was recently completed on a party wall matter relating to an extension to a semi-detached house to the north of Upton. Our Director Justin Burns acted for the housing association that own the adjoining property. When an adjoining owner receives a party wall notice they have the option to dissent and appoint a surveyor of their choice. Fees are paid by the owner undertaking the works but they must be reasonable.
The works in this case involved a single storey rear extension. The two properties were not connected but the depth and proximity of the foundations to the extension brought the works within the scope of the Act. Adjacent excavation is notifiable due to the risk of ground movement. The works dragged on well beyond the original programme but were completed without any damage to our appointing owner’s property.

Upton is a built up, residential area that is very much a part of the East End. The area has a good choice of schools and there are a variety of leisure activities available in and around Upton. Housing is reasonably priced by London standards and yet there is still convenient access into the centre of the capital. There is a mix of good stock Victorian and Edwardian properties, as well as council and private new-build flats.
Upton doesn’t have a dedicated train or underground station but it is located on the line with Upton Park and Plaistow stations so there is are fairly good transport options. These underground stations are both in zone 3 and are on the Hammersmith & City and District lines with frequent services into the City and across to North/West London.
