WHAT IS THE PARTY WALL ACT?

We are vastly experienced in party wall matters whether acting for the building owner, adjoining owner or as agreed surveyor. Disputes are resolved by the preparation of a party wall award; a legally binding document that sets out the rights and responsibilities of the respective owners in relation to the proposed works.

The process starts with the party who proposes to undertake the works formally notifying the owners of any affected neighbouring properties. If the adjoining owner is relaxed about the proposals, they may decide to consent to the notice. In that scenario, we would still recommend that a detailed schedule of condition is prepared covering the adjacent parts of the adjoining owner’s property so that any damage reported can be quickly identified and made good.

If a notice is not consented to, a dispute arises and both parties must appoint a surveyor although they can concur in the appointment of a single agreed surveyor. The surveyor or surveyors prepare a party wall award which authorises the works but ensures that the adjoining owner’s property is protected and the occupants do not suffer unnecessary inconvenience.

RECENT ACTIVITY IN SOUTH EAST LONDON

We were approached by a client who required a Capital Gains Tax valuation for a two-bedroom flat in Lewisham, as they intended to sell the property to a family member. In these situations, HMRC requires a valuation to establish the correct market value at the date of transfer and to ensure tax calculations are accurate.

Our surveyor, Steve Hobbs, attended the property to carry out an internal inspection, measuring the area and noting the flat’s condition and layout. While there were no directly comparable recent sales within the same development, Steve sourced five strong comparables from similar flats in the surrounding area and made careful adjustments to account for differences. Using these, he calculated a fair valuation figure and prepared a clear report.

The client later left a review describing the process as “helpful & efficient” and stating that they would recommend our services “without hesitation.”

A client contacted us to request an RICS Level 2 Homebuyer report for a four-bedroom house in Greenwich, SE10.

David Breeze conducted the inspection and found that the property was in a satisfactory condition. However, several components of the house were still from the original construction and showed significant signs of wear and tear. David noted that these elements were nearing the end of their serviceable lifespan and may need renewal and replacement.

During the inspection, he also recorded condensation around the walls of the staircase, indicating a need for improvements to internal temperature and ventilation. In a follow-up phone call, he advised the client to prepare for potential costs related to repairs and replacements in the short to medium term.

An RICS Level 2 (Homebuyer) survey was carried out by one of our surveyors, David Breeze for a two-bedroom flat located in Greenwich SE10. The property was in a satisfactory condition overall, with a few minor issues, such as worn window seals which David advised would soon need replacing.

David identified a major issue to do with dampness within the walls and floors. Upon investigation, he discovered that the one source of the of the dampness was linked to the underfloor heating which had a leak. This issue was not known to both the freeholder or vendor of the property. David had several conversations with the client where he discussed his findings and addressed worries and concerns that the client had. David gave advice to the client on how to discuss issues, such as the leak, with the vendor to find a resolution.

Before the inspection, David had a detailed call with the client to understand their expectations and clearly explained what the report would cover, he also maintained ongoing communication with the client throughout the process. During the inspection, David observed that the windows were in poor condition and required replacement, due to dampness around them. He also discussed with the client the implications of the property being located in a conservation area and the potential issues that could arise from it. Following their discussions, the client was able to proceed with the purchase of the property, fully informed about the necessary improvements for the flat.

One of our experienced surveyors conducted an RICS Level 2 Homebuyer inspection on a two-bedroom purpose-built flat in Rotherhithe, SE16. The property was found to be well-maintained, with no major issues for the client to be concerned about. The only recommended improvement was the renewal of worn mastic seals, which were causing minor condensation around windows. The fittings and finishes throughout the flat were in good condition and unlikely to require repairs in the near future. The report also offered general advice, such as reviewing how the service charge would be allocated and being aware of any potential upcoming works.

The findings were presented in our easy-to-understand report, which uses a traffic light system to indicate the severity of each issue. Green signifies elements in good condition, yellow highlights advisory concerns, and red marks issues needing urgent attention.

I requested a level 3 survey and while on the more expensive side, I am so pleased with the service I received!!
